ONTARIO CLIMBING ACCESS COALITION/ COALITION POUR L’ACCES AUX PAROIS D’ESCALADE DE L’ONTARIO (the “Corporation”) MEMBERSHIP AGREEMENT
1. I hereby apply for regular membership in the Corporation and enclose payment of the prescribed membership fee of $5.00 and the additional amount of $ that I choose to pay at this time as voluntary membership dues. I agree (a) that my membership is subject to the by-laws of the Corporation in effect from time to time and (b) to be bound by the Corporation’s Code of Conduct as posted on the Corporation’s website from time to time.
2. I confirm that I climb at my own choice and, intending to be legally bound, hereby acknowledge and agree to assume all risk of injury and loss of any kind whatsoever in my climbing activities (“Climbing Activities”), including without limitation, any event sponsored by the Corporation or climbing any route equipped (including, without limitation, as part of the Halton Rebolting Project) by the Corporation or any of its directors, members, employees, agents or representatives (collectively, with the Corporation, the “OAC”).
3. I agree with the OAC that I shall be solely responsible for all claims, demands, damages, costs, expenses, actions, causes of action, whether in law or in equity, resulting from any personal injury, or property damage, or for the loss or theft of property, however caused, and whether contributed to by the negligence of the OAC (“Claims”).
4. I hereby indemnify and save harmless the OAC and any of their respective successors and assigns from and against all liability whatsoever resulting from any personal injury, property damage, loss or theft referred to in the preceding paragraph. I hereby waive, release and forever discharge the OAC and any of their respective successors and assigns, to the fullest extent permitted by law, from any and all Claims as a result of, relating to or arising from my participation in Climbing Activities.
5. I acknowledge that Climbing Activities carry with them an inherent risk of personal injury, and may involve property damage and loss or theft of personal property and I confirm that I am well aware of and understand these risks. I further acknowledge that I am executing this document and participating in Climbing Activities voluntarily and that I freely and voluntarily assume any and all dangers, risks and hazards arising through participation in Climbing Activities.
6. This Membership Agreement shall be binding upon me and my heirs, executors, administrators and assigns, shall be governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein. Sections 2 through 6 of this Membership Agreement shall continue in full force and effect even if I cease to be a member of the Corporation for any reason.
